Introduction. Today, vehicles are an integral part of the infrastructure of every city. The development of rental, leasing, and credit options, in turn, makes driving a vehicle more and more accessible. However, the accident rate is also increasing. The author of the article presents a hypothesis that the key and system-forming element in the structure of the criminalistic characteristics of such a crime as driving a vehicle while intoxicated is the personality of the offender. The typical socio-demographic, moral and psychological, criminal-legal, administrative-legal, physical characteristics of a person who committed a crime under Article 264.1 of the Criminal Code of the Russian Federation, as well as characteristics of property and legal relations and connections in which he or she is located, are identified and analyzed. Methods. The study used a general method of cognition, as well as methods of questionnaires, analysis and synthesis, hypothetico-deductive and comparative-legal methods. Results. Based on the analysis of theoretical provisions of the criminalistic methodology for investigating crimes, as well as materials of 109 criminal cases initiated under Article 264.1 of the Criminal Code of the Russian Federation, five main characteristics of the criminal's personality as an element of the criminalistic characteristics of the crime in question were determined. During the study, the hypothesis was confirmed that the subject of this crime is not a driver who professionally drives public transport vehicles.
