A priori foundations for citizens’ provision of confidential assistance to the police in combatting crime

Abstract:
Introduction. The relevance of the study is rooted in the absence of comprehensive studies within the operational and investigative science, addressing a priori foundations for confidential cooperation with the police in the context of combatting crime and crime prevention. Previously, these issues were examined fragmentarily as part of studies into other aspects of operational and investigative activities. This approach did not allow for the formation of a comprehensive understanding of the nature and functions of a priori foundations. The problem lies in the necessity to distinguish between the concepts of “a priori foundations” and the “socio-legal foundation” for cooperation, which are frequently conflated. The issue of the connection between a priori foundations and the doctrine of natural law remains a subject of debate. Methods. The study is based on general scientific methods, including systems analysis, formal-logical analysis and comparative legal analysis. Conceptual and categorical analysis was applied in order to distinguish between related concepts. The historical-legal method was used to assess the evolution of perspectives on confidential cooperation. The methodological framework was also based on the principles of operational and investigative science, including approaches to identifying a priori premises of legal regulation. Results. This study represents a significant development in the field of academia, as it is the first to comprehensively investigate the a priori foundations for confidential cooperation. It has shown that “a priori foundations” and “socio-legal foundation” are autonomous objects of research requiring independent study. It has been demonstrated that a priori foundations cannot be rigidly linked to the doctrine of natural law, however, a partial overlap in certain aspects is admissible. The key conclusions of the study can be used to improve the theory of operational and investigative activities and law enforcement practice.
