Introduction. The article discusses the features of the presentation of the results of operational and investigative activities in the resumption of criminal proceedings due to new circumstances or newly discovered circumstances. The study is based on the analysis of the regulatory provisions of the criminal procedure and operational-search legislation of the Russian Federation and the legislation of the Republic of Tajikistan, as well as on the materials from judicial practice. It is shown that the results of operationalsearch activities, which are considered in the process of reviewing court decisions when the criminal case is resumed, occupy an intermediate position between evidence and a source of information intended to verify the reliability of previously established circumstances. The analysis reveals that the legislation does not distinguish between the forms of presentation of operational materials depending on the stage of criminal proceedings, which leads to the lack of uniformity in law enforcement practice. Methods. The research methodology includes a systematic approach used to analyse the interaction between the institutions of criminal proceedings and operational investigative activities; a formal legal method that identifies logical and conceptual connections between the norms of these sources; and a comparative legal analysis that allows to identify common features and differences in the regulation of the procedures for presenting the results of operational investigative activities in Russia and in the Republic of Tajikistan. Results. The author introduces the concept of a “double standard of procedural admissibility” for the results of operational investigative activities. In the evidence-based plan a strict admissibility regime is maintained, based on the verification of the legality of obtaining and documenting materials. In the information-based plan, when data from operational and investigative activities are used to review cases or make other procedural decisions, a more flexible approach is applied, focusing on the substantive reliability of the information. This distinction is not legally established, but it has actually developed in judicial practice and reflects the adaptation of procedural mechanisms to the needs of judicial control. Conclusion. The article concludes that a special legal regime has been formed for presenting the results of operational and investigative activities when criminal cases are resumed due to new or newly discovered circumstances, which combines elements of evidence and control. This regime requires further theoretical analysis and clarification of its place in the system of criminal proceedings.
