Introduction. The article reveals the psychological characteristics of the emergence of conflict situations between a person conducting the preliminary investigation and people suspected or accused of committing criminal offences. The authors analyse in detail various aspects that influence the emergence and development of conflict, and consider the nature of the investigative situation that arises in this process and its specific features, which, when influenced, can be transformed by the investigator into a situation that is more favorable for the investigation. Methods. To achieve the research objectives and goals, general scientific methods were used, as well as analysis and synthesis, induction and deduction, systemicstructural, concrete-sociological, comparative-legal, sociological, statistical, linguistic, and formal-logical methods. Results. The authors reveal the peculiarities of the emergence of conflict situations. It has been determined that the issue of criminal investigation tactics can ultimately be reduced to one central task – the optimal interaction of the investigator with various participants in the criminal process, which requires consideration of legal, psychological and ethical aspects. At present, issues of communication and interpersonal interaction are being studied by a variety of scientific disciplines, but it is psychology in particular that pays increased attention to the development of the technological aspects of communication. It can be argued that the methodological principles underlying the solution of problems related to criminal investigation tactics are largely based on psychological knowledge and approaches. A critical analysis of concepts related to conflicts in the activities of the subject of investigation made it possible to identify several key concepts, including “conflict situation”, “conflict”, and “conflict situation”. This differentiation of concepts has made it possible to formulate and solve separate, albeit interrelated, tasks, which include the development of tools for analysing conflict situations, as well as the creation of methods that will help investigators to act effectively in conflict situations.
