Abstract (English):
Introduction. The relevance of the study of legal and organisational aspects of procedural control during the completion stage of the preliminary investigation is due to the fact that it ensures the validity, legality and fairness of the investigator’s final decisions, which are important both for the subsequent criminal case flow and for the future of participants of legal proceedings involved in a particular trial. The problem lies in a number of debatable issues related to the legal regulation and organisation of procedural control at this stage, as well as in the insufficient effectiveness of its implementation in practice, as evidenced by the materials of judicial practice. The purpose of the article is to analyse the legal and organisational aspects of procedural control at the completion stage of the preliminary investigation. The concept of the completion stage of the preliminary investigation, procedural control and its correlation with departmental control is disclosed, which allows to reveal the legal and organisational basis for the functioning of procedural control. It is emphasised that the effectiveness of procedural control is determined by the combination of legal and organisational factors. Methods. The following methods were used in the course of the research: analysis, synthesis, induction, deduction, formal-legal method, judicial practice analysis, system-structural method. Results. Legal and organisational specifics of procedural control at the completion stage of the preliminary investigation were established, as well as the problematic aspects in this area related to the lack of proper regulation of the terms during which procedural control at the completion stage of the preliminary investigation should be implemented. Deficiencies in the requirements for candidates for the position of an investigative body head have also been identified, which, among other things, has a negative impact on procedural control at the completion stage of the preliminary investigation. This problem is confirmed by the materials of court practice. Recommendations aimed at eliminating outlined problems are suggested.
