Introduction. Article 356 of the Criminal Code of the Russian Federation establishes criminal liability for committing the most socially dangerous crimes recognised by the entire world community – war crimes. The use of methods of warfare prohibited by international treaties of the Russian Federation is enshrined as alternative actions of committing the offence. At the same time, this norm does not contain their specification. Accordingly, questions in the qualification of offences are raised. The author reveals the problems of the terminology enshrined but not specified in the article, peculiarities of interpretation and problems of application of international treaties of the Russian Federation by law enforcers. As a result of the study, independent conclusions are formulated on the shortcomings of the construction of the disposition of the considered norm of the criminal law and the need to change it by singling out as an independent corpus delicti of war crimes the use of methods of warfare prohibited by an international treaty of the Russian Federation. The relevance of the study is undoubted, since at present there is a large number of armed conflicts and similar offences are committed. Defending the inevitability of punishment for the commission of war crimes, Russia, complying with the norms of international law, should have a legal opportunity to implement the mechanism of such responsibility. Methods. The methods of description, analysis, comparison and systematic method of research were applied. Results. The results of the research are the final conclusions of the author regarding the peculiarities of determining the qualification of prohibited methods of warfare as an alternative act provided for by Part 1 of Article 356 of the Criminal Code of the Russian Federation. The conclusion formulates recommendations and proposals for possible changes in the considered norm of the criminal law. In order to more effectively apply it in terms of establishing the use of prohibited methods of warfare as an alternative socially dangerous act in the qualification of war crimes.
