REPRESENTING THE INTERROGATOR AS A MEANS ELIMINATION OF THE CIRCUMSTANCES THAT CONTRIBUTED TO THE COMMISSION OF THE CRIME

Abstract (English):
IIntroduction. The article examines the activities of the investigator as a subject of the departmental prevention system, expressed in: identifying the circumstances (causes and conditions) that contributed to the commission of a crime; making representations to the relevant organization or the relevant official about taking measures to eliminate these circumstances or other violations of the law; monitoring the receipt of a response on its implementation. Attention is focused on modern problems of legal regulation of the designated activity: the absence in the order of the Ministry of Internal Affairs of Russia dated 08/24/2023 No. 619 "On some organizational issues of the activities of the internal Affairs bodies of the Russian Federation for the prevention of offenses" of more substantive normative prescriptions defining the main forms and methods of work of the investigator; ambiguous regulation in part 2 of Article 158 of the Code of Criminal Procedure of the Russian Federation of the procedure for making a submission to the relevant authorities, enterprises, institutions, organizations and the sequence of actions in case of its intentional non-fulfillment. Methods. The research is based on general scientific and private scientific methods of scientific cognition: analysis and synthesis, system-structural, formal-legal, comparative-legal, logical, statistical. Results. Based on the results of the study, conclusions are formulated that representation is an important procedural means of responding to the circumstances that contributed to the commission of a crime and serves as a guarantor of their elimination. Proposals have been developed to introduce legislative amendments to the provisions of Part 2 of Article 158 of the Code of Criminal Procedure of the Russian Federation and to expand the provisions of the Order of the Ministry of Internal Affairs of Russia dated 08/24/2023 No. 619 "On certain organizational issues of the activities of the internal affairs bodies of the Russian Federation for the prevention of offenses".
