Expanding the conceptual apparatus as a basis for the formation of criminal proceedings in special conditions

Abstract (English):
Introduction. Non-standard conditions reflected in the legal regimes of martial law, state of emergency, emergency situation and counter-terrorist operation have a serious impact on criminal proceedings. The implementation of criminal procedural activities under their introduction according to the previous rules may not only not contribute to the achievement of tasks, but also additionally complicate the situation. In this regard, it seems important to adapt criminal proceedings to activities in other realities. For this purpose, it is necessary at the theoretical and applied levels to admit that criminal proceedings in standard conditions and in conditions of other legal regimes should be different. This entails raising the question of adding to the conceptual apparatus the terms characterising the activities of the bodies carrying out criminal proceedings under everyday conditions and under special conditions as a basis for the formation of a new direction for the development of criminal procedural legislation under special conditions. Methods. The methods of analysis, synthesis and comparative jurisprudence were used in the research process. The results of the research consist in the formulation of new criminal procedural terms: ‘regime of everyday activity’, ‘special legal regime’, ‘special legal regime’ in order to introduce them into doctrinal criminal procedural regulation.
