Introduction. The article is devoted to the study of the legal nature of the category “digital space”, its place and role in the structure of modern civil law. The author considers digital space as a new sphere of social relations, formed due to the development of information and communication technologies and digitalization of all aspects of society. The work analyzes modern approaches to defining the concept o “digital space”, as well as its difference from such categories as “virtual environment” and “digital environment”. The article formulates conclusions regarding the prospects for further legislative regulation of the status of digital space in civil legislation, and provides the author's definition of this definition. Methods. The research methodology is based on an integrated approach, including the use of logical-analytical, historical, philosophical-methodological, as well as formallegal and comparative-legal methods. Results. The main results are: firstly, digital space has become an independent element of civil legal relations, forming a new object of civil rights along with the material world; secondly, the legislator has enshrined the concept of “digital rights” by defining key objects: digital currencies, tokens, accounts, personal data and intellectual property, which require special civil law regulation; thirdly, the digital space cannot be considered a virtual environment, but the virtual environment always exists within the digital space as one of its parts, which is important for the regulatory framework of the area of knowledge in question; fourthly, the digital space is “the entire digital world” as a global infrastructure and information context, and the digital environment is a “digital context” or “ecosystem” for a specific activity (for example, training), including technologies, resources and methods of interaction; fifthly, further development of regulatory acts is required that take into account the specifics of the digital space, including mechanisms for protecting the rights of subjects and minimizing cyber threats.
