The influence of forensic examination principles on the formation of internal conviction of participants in criminal proceedings
Abstract and keywords
Abstract (English):
Introduction. The article examines the correlation between forensic examination principles and the formation of internal convictions among participants in criminal proceedings. The relevance of the study is due to the incompleteness of the list of procedural and scientific principles of forensic examination. This incompleteness directly impacts the formation of internal convictions among participants in criminal proceedings. It is important to note that the insufficient development of these principles may lead to different interpretations and difficulties in assessing the content of expert opinions by participants in criminal proceedings. Methods. The methodological basis of the study was formed by a combination of scientific methods: synthesis, induction, deduction, generalization, information processing, and logical analysis. Results. The importance of compliance with the requirements of forensic examination principles for determining a clear and well-founded position among participants in criminal proceedings is demonstrated. The content of each principle is analyzed in order to identify the key elements that determine the importance of their compliance. It has been established that forming an internal conviction is a complex process that depends not only on the expert's personality, the quality of their work, and their conclusions, but also on the subjective qualities of the trial participants, their professional training, and their erudition. Therefore, an expert must always consider the audience for the evidence, that is, those they must help form an internal conviction. The opportunity to personally verify the expert's conclusions, participate in the forensic examination, and see the expert's findings in their report strengthens the conviction of those involved in the criminal proceedings in the veracity of their findings
