Abstract:
Criminal law plays a major role in protecting the interests of citizens from the most dangerous attacks. Since criminal law is the main regulator of the most important social relations, it is extremely difficult to imagine the further progress of mankind without it. Initiatives to change the criminal law are currently overwhelmingly aimed at improving the mechanisms of criminal law regulation of current social relations by increasing, expanding and complicating the designs of criminal law prohibitions. Situational, unjustified and excessive expansion of the scope of criminal legal regulation does much more harm than good. Spontaneous detailing of violations is also harmful, since a casuistic description cannot cover the entire variety of manifestations of criminal consciousness and will that modern reality presents to us. Criminal punishment should be applied only in cases where it is not possible to protect new rights and interests from harm by other legal means. In this regard, the article proposes the most optimal, effective and efficient areas of criminal lawmaking.
