Issues related to the conduct of judicially authorized operational investigative measures by units of the Federal Penitentiary Service of Russia to locate convicted persons

Abstract (English):
Introduction. This article presents some of the results of a study devoted to the problems of searching for convicted persons evading their sentences. The search for individuals in this category is one of the main tasks performed by operational units of the Federal Penitentiary Service (hereinafter referred to as the FSIN of Russia). The performance of official duties by their employees is significantly hampered by the inability to conduct operational-search measures that restrict the constitutional rights of individuals and citizens in order to locate absconding convicts. The authors of the article analyze the opinions of prominent scholars on ways to improve the effectiveness of the search for convicts absconding from the FSIN of Russia. Methods. The study utilized a dialectical method of cognition. This revealed significant contradictions in the legal regulation of the issue under study. In addition, content analysis, expert assessments, and interviews were used. Results. Gaps in the legal framework implemented by the Federal Law «On Operational Investigative Activities» prevent the FSIN's operational units from locating convicted individuals using effective investigative measures such as wiretapping, interception of technical communications channels, and the acquisition of computer data. The typical investigative situations examined demonstrate the inconsistency of the provisions of the Federal Law «On Operational Investigative Activities» regarding the grounds and conditions for conducting operational investigative activities. Implementation of the legislative innovations proposed by the authors of this article could significantly improve the effectiveness of the FSIN's operational units' investigative work.
