Introduction. Safety risks represent special equivalent of the threat of harm to public relations maintained by law. At first sight, safety risks are reflected only in signs of objective side of the actus reus. However, they can be spoken about as applied to other elements of corpus delicti. If we consider the crimes against transport safety, then risks can be referred to the transport means as the object of the crime, to the act and its consequences, to the subject of the crime, his personality and even to a form of quilt. Therefore the issue of the safety risks’ reflection in the crime is actual [1]. The role of safety risks in the criminological mechanism of committing the crime gradually starts interesting not only criminal law science but criminological science too [2]. Methods. The main task is the classification of risks, the determination of their crime rates. It is impossible to cover the issue about the diverse of risks’ influence on public safety in a short article; therefore we pay attention to their basic hubs of crimes. They are exactly transport means as a source of the highest danger, traffic violations and the use of vehicles, and personal characteristics of the driver. Results. The information about the meaning of safety risks must be taken into account when the speech is about criminalisation and de-criminalisation of acts in the transport sphere that is the level of safety risks may be their criterion. Such kind of information is useful when differentiating the responsibility for traffic violations in the scope of sectoral regulation. For risks’ reflection in the crime it is necessary its appropriate construction. That is why in some articles it is demanded the optimisation of the corpus delicti construction about the responsibility for transport means in order to exclude the undervaluing of safety risks. Such a construction may be corpus delicti of risk creation.
